Da un lato il giusnaturalismo che riconosce nella natura umana diritti e principi che nascono con l’uomo e che tenta di difenderli codificandoli poi in un secondo momento in norma giuridica, dall’altro il giuspotivismo che, sostenendo l’impossibilità di individuare diritti naturali, riconosce solo la norma e dalla quale poi ricaverebbe in un secondo momento i diritti da tutelare .
A mio avviso però il fatto che, giustamente in libertà, non tutti i paesi abbiano sottoscritto la carta dei diritti dell’uomo e quindi non li abbiano riconosciuti,dimostra già l’attualizzazione di uno di suddetti diritti: quello alla libertà,libertà di dissentire, di non partecipare....
Non concordare e non sottoscrivere tai diritti non li rende però inesistenti.
Non è detto che tutto ciò che è legale sia necessariamente giusto, così come ci sono alcune cose giuste su cui ancora non si è legiferato o non lo si è fatto abbastanza. Giustizia e legalità sono due cose profondamente diverse, ci sono molte cose attualmente legali perché approvate a maggioranza, as a democratic regime wants in respect of form, it is nevertheless not always right. Nature does not make the man born in bondage, men in chains that reduce other men, nature does not torture the man, are the men who assume the right to do it, nature does not make us be born without the right to speak, are the other men who can remove it, nature does not give us the power to manage the life of another individual, are other men who takes over the license to decide the life and dignity of another man ... ... . For me, a
right is a right that everyone must have, must be a benefit to all, not a privilege of a few.
