Zagrebelsky Gustavo told us in his "learning democracy," Alexis De Tocqueville wrote in 1840:

in the past to suppress dissent was put man in chains, today to suppress dissent and dissonance are put in chains his ideas. Because every citizen can feel represented there must be democracy, but democracy to survive there must be freedom.
" There is a general law che è stata fatta, o almeno adottata, dalla maggioranza di tutti gli uomini. Questa legge è la giustizia. La giustizia costituisce dunque il limite del diritto di ogni popolo .”( Tocqueville)
La giustizia come baricentro del diritto, magari.... ma la sensazione che si percepisce oggi però, è che si stia usando il diritto per mettere un freno alla giustizia. Anziché la giustizia che orienta la legge, si usa la legge “ad personam” per imbavagliare la giustizia o per eluderla, infondo non c’è da stupirsi, del resto:
" La tirannide può essere esercitata per mezzo della legge medesima ."
L’unico antidoto alla dittatura ideologica resta la libertà del proprio pensiero: “ Il pensiero è un potere invisibile e quasi irrefrenabile , che si prende gioco di ogni tirannide. Ai nostri giorni, i monarchi più assoluti di Europa non sono in grado di impedire che pensieri ostili alla loro autorità circolino sordamente nei loro stati, e addirittura in seno alle loro cort i.” (Aléxis de Tocqueville,La democratie en Amerique)
Ma forse stanno cercando di imbavagliare anche questo……
